Seabed Geosolutions Files Answer to FairfieldNodal’s Patent Infringement Allegations
Seabed Geosolutions believes that the entirety of FairfieldNodal’s complaint is meritless and will vigorously defend the lawsuit. As an industry leader in ocean bottom seismic technology, we are a pioneer in ocean bottom seismic and have invested in developing industry leading technology for over 20 years. Seabed Geosolutions respects the intellectual property rights of competitors in our industry, but we will vigorously defend against any meritless intellectual property infringement litigation that is asserted against us.
On 11 July 2018, Seabed Geosolutions filed an answer denying all of FairfieldNodal’s allegations of patent infringement in the United States District Court for the Southern District of Texas. Seabed Geosolutions categorically denied any infringement of any of FairfieldNodal’s patent claims, and in addition, asserted that FairfieldNodal’s asserted patent claims are invalid and/or unenforceable. Furthermore, Seabed Geosolutions asserted a counterclaim of unfair competition against FairfieldNodal and seeks an award of its attorney’s fees.
On 25 June 2018, Seabed Geosolutions filed a petition for Inter Partes Review in the United States Patent and Trademark Office (USPTO) challenging the validity of Fairfield’s U.S. Patent No. 9,829,589. This is in addition to pending petitions for Inter Partes Review of Fairfield’s U.S. Patent Nos. RE45,268, 8,228,761, and 8,879,362 that were filed by Seabed Geosolutions in the USPTO in April 2018. Seabed Geosolutions is confident that the USPTO will institute a review of all of the challenged patents.
